Saif Gaddafi may now be tried in Libya before International Criminal Court... and could face death penalty if found guilty

A son of Colonel Gaddafi could be tried in Libya for crimes against humanity, it emerged yesterday.

The International Criminal Court (ICC) had been insisting that Saif al-Islam Gaddafi must be handed over to the Hague to face justice.

The 39-year-old faces trial for killing, torturing and persecuting civilians in the early days of last year’s uprising.

But the authorities in Tripoli have refused to transfer Saif al-Islam, captured by pro-democracy fighters in the final days of the war, despite the threat of United Nations sanctions.

Now it has been revealed that he could be tried on Libyan soil but under ICC supervision.

A special court would be set up in his homeland but with security and legal supervision provided by international officials.

A Western source close to the case told the BBC that a deal was near to being agreed.

The official acknowledged concerns that Saif al-Islam could face the death penalty in Libya for his role in the brutal crackdown on pro-freedom protesters.

But he said the ICC would accept a death sentence if the trial was fair and transparent and there was an adequate appeals process. Read More
